By using any of the Services and the Site, You expressly agree to be bound by these terms and all applicable laws and regulations governing the Site and the Services. The terms form a legally binding agreement between you and www.youhire.me in relation to your use of the Site and/ or the Services and applies to all users of the Services, whether registered or not, on the Site.

As used in this Agreement, “www.youhire.me", "we," "us," and "our" shall mean YouHire and its subsidiaries and affiliates. By accessing or using the services available through our website (the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy currently found at https://www.youhire.me/terms-of-use.html and https://www.youhire.me/privacy-policy.html and incorporated herein by reference. These Terms do not alter in any way the terms or conditions of any other agreement you may have with YouHire for products, services or otherwise. If you are using the Services on behalf of any entity, you represent that you are authorized to do so.

We may, at our sole discretion, modify or revise these Terms of Service and policies at any time by giving notice on our Website and/or through the Services, and you agree to be bound by such modifications or revisions. Although YouHire may attempt to notify you when major changes are made to these Terms of Service, you should periodically click on our Terms of Service to review any updates. All changes shall be effective immediately when we post them and shall apply to all access to and use of our website thereafter. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits hereunder.

The YouHire acts as a passive conduit for the online distribution and publication of User Content and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring User Content posted by Users. However, the YouHire may review and delete any User Content that, in the sole judgment of YouHire, violates these Terms of Use, violates applicable law, rule or regulation, is offensive or illegal or violates the rights of, harms or threatens the safety of Users of YouHire. The Company reserves the right to expel Users and prevent their further access to the YouHire for violating the Terms of Use or applicable law, rule or regulation and the right to remove User Content which is in violation of the Terms of Use, abusive, illegal, or disruptive.

 

Obligations Of Users

To access and use certain features of the Services, you may be required to register for an account. By creating an account, you agree to: (i) provide accurate, current and complete account information; (ii) maintain the security of your password, not share your password with any other person and accept all risks of unauthorized access to your account; and (iii) promptly provide notice to info@youhire.me if you discover or otherwise suspect any security breaches related to the Services.

Users will not use the Services if any applicable law in their country prohibits them from doing so and/ or have not previously been their right to use the Services suspended or terminated.


The user shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or racially, ethnically, or otherwise objectionable.

The user expressly states that the resume/insertion or information/ data being fed into the network of YouHire by the user is correct and complete in all respects and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. YouHire expressly disclaims any liability arising out of the said resume insertion/information/ data so fed into the network of YouHire by the user. Further, the user agrees to indemnify YouHire for all losses incurred by YouHire due to any false, distorted, manipulated, defamatory, libelous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by the user on the network of YouHire

The User is solely responsible for maintaining confidentiality of the User password and user identification and all activities and transmission performed by the User through his user identification and shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions and YouHire assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the subscriber online / off-line.

It shall be sole prerogative and responsibility of the user to check the authenticity of all or any response received for any job or interview or video call. YouHire assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which the user may so do.

Uploading of multiple resumes beyond a reasonable limit by the same individual, using the same or different accounts shall entitle YouHire to remove the Resumes without notice to the subscriber. This service is only meant for bona fide candidates looking for suitable jobs. Any usage with commercial intent is prohibited. 

You may be contacted by YouHire email, telephone and/or post. We recommend that you read the privacy settings carefully and YouHire will not be held responsible for contacts/mails received by you. If you receive job alerts (mails detailing jobs that match your profile as entered on YouHire) via email, you have choice to remove yourself from the job alert email database by resetting this option in the Privacy Setting.

Furthermore User’s must not:

  • Post any resume or apply for any job on behalf of another party;
  • Refer any contact from an employer to any agent, agency, or other third party;
  • Solicit passwords or personally identifiable information from other Users;
  • Post jobs or content on YouHire that contain any hyperlinks, email addresses, HTML Tags, "hidden" keywords or any keywords that are irrelevant to the job or are otherwise misleading;
  • Use YouHire Resume Database for any purpose other than as an employee of the company helping his/her employer finding the best candidates, including but not limited to using the information in the Resume Database to sell or promote any products or services;
  • Post or submit to YouHire any incomplete, false or inaccurate biographical information or information which is not your own;
  • Send unsolicited mail or e-mail, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a user of YouHire; and
  • Use any data mining, robots or similar data gathering or extraction methods.

 Notwithstanding anything to the contrary contained herein, use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search any YouHire Site other than the search engine and search agents available from the Company on YouHire.

 

Obligations of Job Publisher:

  • The Job Publisher must only get in touch with candidate through YouHire, and must not bypass the YouHire and get in touch with the candidate;
  • Job Publisher must verify his/her account via LinkedIn; and
  • Job Publisher must not publish job descriptions from companies he/she does not work for.

Payment

In order to use instant messaging facility and talk to the job publisher, he/she is required to pay a prescribed fee. Once the online interview commences, thereafter either party to the interview shall pay to schedule a video interview by using video call facility available on the website. User must pay for the Service via PayPal or other payment method authorized at the time of registration. The payment policies for Users may change at any time.
 
The service once subscribed to by the user is not refundable and all amount(s) paid shall stand appropriated. However, in certain situations YouHire, in its sole discretion, may decide to refund the received payment partially or completely. For example, if the job publisher does not respond within 48 hours, the payment may be refunded partially or completely.

The subscription fee paid entitles the subscriber only for one conversation under the job description or one time use of video call facility. For repeated availing of the service, additional charges will have to be paid.

This subscription is not transferable i.e. it is for the same person throughout the period of subscription.

Suspension And Termination Of Account And Service

Generally, a User Account will be considered active until we receive a user request to deactivate or delete it. YouHire takes steps to verify the credentials and company status of its members. We do not guarantee that the Website or any content contained on the Website will always be available or be uninterrupted. We reserve the right to limit, suspend, terminate, modify, or delete the User Account we provide to you or your access to our Services or portions thereof (including any Content you or other users submit) for any reason, with or without notice and at any time, including, without limitation, if you are, or we suspect that you are, improperly using the Services, violating any applicable laws or failing to comply with this Terms of Service. We also reserve the right to stop offering and/or supporting the Services or any part of the Services at any time either permanently or temporarily, for any reason, with or without notice to you, at which point your use of the Services or any part thereof will be automatically terminated or suspended.

Use Of The Services


Except as otherwise agreed upon, we hereby grant you a limited, nonexclusive, non-sub-licensable license to access, and use the Platform and Content solely for personal and noncommercial purposes, conditioned on your compliance with these Terms. You will not use, copy, adapt, modify, decompile, reverse engineer, disassemble, decrypt, attempt to derive the source code, prepare derivative works based upon, distribute, license, sell, rent, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Platform and Content, except as expressly permitted by YouHire or as permitted under applicable law. Any unauthorized use of the Services is strictly prohibited and will terminate the license granted in these Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you. YouHire reserves its right to reject and delete any resume/ insertion or information/data fed in by the user without assigning any reason.

YouHire will not be liable on account of any inaccuracy of information on this web site. It is the responsibility of the visitor to further research the information on the site. The user undertakes not to duplicate, download publish, modify and distribute material on YouHire unless specifically authorized by YouHire in this regard

Third Party Links, Content And Services

Any and all contents and services (including advertising) within YouHire that are not owned by YouHire are "third party content and services." YouHire acts merely as an intermediary service provider of, and accepts no responsibility or liability for third party content and services. In addition and without limiting the generality of the foregoing, YouHire may include links to sites operated by third parties, including advertisers and other content providers. Those sites may collect data or solicit personal information from you. YouHire does not control such sites, and is not responsible for their content, policies, or collection, use or disclosure of any information those sites may collect.  

Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:

  • In any way that violates any applicable local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from Canada. or other countries).
  • For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise.
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail", "chain letter" or "spam" or any other similar solicitation.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm the Company or users of the Website or expose them to liability.

Additionally, you agree not to:

  • Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Website, including their ability to engage in real time activities through the Website.
  • Gain a competitive advantage over any businesses in your sector.

  • Use any manual process to monitor or copy any of the material on the Website or for any other unauthorized purpose without our prior written consent.
  • Violate the privacy of others

  • decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Website.

The information presented on or through the Website is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of this information. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

Limitation of Liability

THOSE WHO ACCESS OR USE THE SERVICES FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.

THIS SERVICE IS ONLY MEANT FOR CANDIDATES LOOKING FOR SUITABLE JOBS. ANY USAGE WITH COMMERCIAL INTENT IS PROHIBITED. YOUHIRE RESERVES ITS RIGHT TO REJECT AND DELETE ANY RESUME/ INSERTION OR INFORMATION/DATA FED IN BY THE USER WITHOUT ASSIGNING ANY REASON.

Disclaimer of Warranties

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Termination

YouHire reserves the right, in its sole discretion to terminate your right to access and use the Services if you violate these Terms or any other terms or policies referenced herein, or if you otherwise create risk or possible legal exposure for us.

Entire Agreement/ Severability

These Terms of Use incorporate our Privacy Policy which together constitutes the entire agreement between You and YouHire, in relation to Your use of the Site and/ or the Services and supersedes any prior representations, inducements or agreements relating to its subject matter. You agree that these Terms of Use are not intended to confer and do not confer any rights or remedies upon any third party. If any part of these Terms of Use are held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. These Terms of Use, including all terms and policies referenced herein, contain the entire understanding, and supersede all prior agreements, between you and YouHire. relating to this subject matter, and cannot be changed or terminated orally. 

Assignment

You may not assign these Terms or any of the rights granted hereunder without the prior written consent of YouHire, and any attempted assignment without such consent shall be void. Subject to the foregoing restriction, these Terms will be fully binding upon, inure to the benefit of, and be enforceable by us and our respective successors and assigns

Nonwaiver

Failure by either YouHire or You to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.

Indemnification

You agree to defend, indemnify and hold harmless YouHire and its respective employees, contractors, officers, directors, shareholders, agents, representatives, vendors, and content providers from and against any and all liabilities, claims and expenses, including attorneys' fees, that arise from a breach of these Terms of Use for which you are responsible or in connection with your transmission of any content to, on or through our website. Without limiting your indemnification obligations described herein, we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Force Majeure

YouHire shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control; including, without limitation, any failure to perform hereunder due to unforeseen circumstances or causes beyond its control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.

Applicable Law, Jurisdiction, And Venue

It is the intention of the parties to this Agreement that this Agreement and the performance under this Agreement, and all suits and special proceedings under this Agreement, be construed in accordance with and Governed, to the exclusion of the law of any other forum, by the laws of the Canada. The Parties hereby agree that all actions brought in respect of this Agreement, or any Services delivered pursuant to this Agreement, shall be brought before a Competent Court of Canada, and the parties hereby acknowledge the exclusive jurisdiction of the Competent Courts of Montreal.

The parties acknowledge that these Terms of Use evidence a transaction involving interstate commerce. Notwithstanding the provision in the preceding paragraph with respect to applicable substantive law.

You and YouHire irrevocably consent to the exclusive jurisdiction and venue of the competent courts of Canada, for all disputes arising out of or relating to these Terms of Use, the subject matter of these Terms of Use, or your access to and use YouHire website, that are heard in court .
